In a Landmark Move Japura Student Files FR Petition to Prevent Future Ragging Incidents

The student of the Sri Jayewardenepura University who was seriously injured in a recent ragging incident is asking the Supreme Court to lay down rules to compel staff to combat violence against freshmen.

Pasindu Hirushan Silva and his sister Attorney Sharmala Priyadarshani Silva have filed a Fundamental Rights Application citing his injuries asking the Apex Court to ensure University staff stringently apply the existing rules and laws pertaining to student discipline to prevent such incidents from happening.

The petition points out that Silva was injured when an allegedly intoxicated senior student rolled a heavy tire down the steps of the University Stadium in the early hours of March 6, 2019.

It hit Silva in the chest and he fell backwards where he suffered brain damage. The then 20-year was rushed to the hospital and was on life-support for a long time and his right side was paralyzed.

He has since recovered somewhat but finds it difficult to walk and cannot write with his Right hand. That was the reason why his sister is a co-petitioner.

In the petition, Silva points out that several university rules were broken that night.

Parties, whether they are “informal” or campus organized have to end by 10 pm. When Silva was struck it was 1:30 in the morning.

Silva’s family have charged that the senior students were under the influence of alcohol at the time.

In both instances, the University rules were not enforced by staff. The family says that if the rules were strictly applied this injury to Silva would not have happened.

The student union of the university has said that this was not a ragging incident.

However, the university suspended 16 senior students and police arrested six of them and they were remanded by the Gangodawila Magistrate.

In many cases of inhuman ragging students have complained that staff had not been present or enforced the rules.
